The ISIPO implements CP8 and CP9

The Icelandic Intellectual Property Office (ISIPO) and the European Union Intellectual Property Office (EUIPO) have jointly prepared two practice papers in relation to the use of a trade mark in a form differing from the one registered (CP8) and the distinctiveness of three-dimensional marks (shape marks) containing verbal and/or figurative elements when the shape is not distinctive in itself (CP9) in the framework of their cooperation efforts.

The practice papers have been prepared in line with the Common Communications resulting from the Common Practices CP8 and CP9 developed by the European Union Intellectual Property Network (EUIPN). Tailored to the specificities of Iceland, the practice papers provide an overview of the Office’s quality standards concerning these topics. Both practice papers provide a clear and comprehensive explanation of the principles on which the practices are based, which will be generally applied by the ISIPO and the intellectual property (IP) offices of the EUIPN.

The practice papers are a tangible result of the EUIPO’s cooperation efforts with non-EU IP offices to harmonise and converge IP practices in order to strengthen IP alliances. The practice papers aim to increase clarity, transparency, legal certainty and predictability for the benefit of the users and examiners.

The practice papers can be found on the ISIPO website in Icelandic and English. The documents are divided into two parts:the first summarising the key messages and statements of the practice principles; the second providing a clear and comprehensive explanation of these principles. They also serve as a reference for all interested parties.
